THE EUROPEAN COURT DELEGATION MEMBERS ASSESSED THE ACTIVITIES OF GEORGIAN JUDICIARY POSITIVELY

On June 25, 2015 chairperson of the Supreme Court Nino Gvenetadze and the judges of Supreme Court met with the European Court of Human Rights Delegation members: Vice-president of European Court of Human Rights Joseph Casadevall, Judge of European Court of Human Rights Nona Tsotsoria and the Deputy Section Registrar Patos Arasis.

The chairperson of the Supreme Court, Nino Gvenetadze, addressed the guests with a welcoming speech and provided them with information of the importance of the third stage reform of judiciary and on implemented changes.  Nino Gvenetadze paid particular attention to the approach established by the Human Rights European Convention and in the context of the high standards the new understanding of the role of the Supreme Court as the last cassation instance court.  

Nino Gvenetadze stated at the meeting that “In the part of the Cassation Complaint Admissibility the approach established by the European Convention and on the basis of the European Court’s precedents the reasoning of the decisions will raise not only Supreme Court’s and related lower courts responsibility from the standpoint of the quality of legal reasoning of decision of motivation part, but also will raise the parties responsibility for justification of the cassation complaint”. 

The Chairperson of the Supreme Court provided the guests with information regarding projects and events through which the continuous trainings for  judges is ongoing for increasing of their knowledge and qualification and that it is important the studying  the  approaches established by the European Convention is underway and the significance of the issue of accessibility of precedents in Georgian language. 

According to the statement of Nino Gvenetadze,  the ratification of the Human Rights European Convention’s 16th protocol is very important achievement for Georgia, which considers the possibility of the Supreme Instance Courts to apply to the European Court with a request for issuing the consultation conclusion.

According to the Chairperson of the Supreme Court it is valuable that the court will be able to utilize this new standard. In relation to the ratification of the protocol, the delegation member Patos Arasis commented on this idea of the Supreme Court Chairperson and gave the high assessment of the current situation existing in Georgian judiciary.  “As a result of effective work of the National court there are fewer complaints from Georgia to the Strasbourg Court. I think this is due to the improvement of a true justice related vision,” stated at the meeting the European Court Delegation member Patos Arasis. 

The striving of the Georgian judiciary towards establishing the European Standards justice was also positively assessed by the supervisor of the delegation Joseph Casedevall. As it was mentioned by Joseph Casadevall in his speech “the ratification of the 16th protocol by Georgia shows how interested is the country and the Georgian judges are to have the ability to conduct legal dialogues with the European Court judges”.

Joseph Casedevall invited Nino Gvenetadze on an official visit to Strasbourg.
