On 6 March 2018 a conference was held at hotel Courtyard Marriott Tbilisi, concerning “Business Disputes and Court Practice” organized by the Supreme Court of Georgia and EU –Georgia Business Council. The conference participants were representatives of business organizations, Chamber of the  Civil Cases of the Supreme Court of Georgia,  the Civil Cases Panel of Tbilisi City Court, High Council of Justice and Georgian Bar Association.  The opening remarks were made by EUGBC Secretary General, Mr. Zviad Chumburidze and the Chairperson of the Supreme Court of Georgia and HCoJ, Ms. Nino Gvenetadze.

Ms. Gvenetadze stated that: “Harmonious relations between Business and Court determine successful development of economic and industrial activity of the country. In case of business disputes, investors have a right to apply to efficient mechanism of the dispute resolution. The role of the state, in this regard, is to fulfill the positive obligations that imply creation of efficient remedial mechanism”. The state should develop a clear and transparent legislative framework and steady court practice that will facilitate business activity of foreign industrial entities.  

Another speaker was Ms. Mzia Todua, deputy chairperson of the Supreme Court of Georgia talking about “„Actual issues related to court disputes entailed by commercial activities carried out in Georgia, problems and perspectives“.

Mrs. Ekaterine Gasitashvili, judge of the Supreme Court of Georgia, presented a report upon “Investment Disputes and Expected Legislative Amendments”.

It is worth noting that the Supreme Court of Georgia has cooperation with business representatives  within the framework of Scientific Advisory Council. Some significant issues have been discussed at the council meetings: labor relations between employers and employees; and with mutual cooperation of National Bank of Georgia a legislative act has been prepared on “ Mutual Deduction of Financial Mortgaging and Derivatives”; a working meeting was organized with the Competition Agency of Georgia on Commitments under EU-Georgia Association Agreement and training seminars have been planned for improvement of the judicial process.  At the personal initiative of the chairperson of the Chamber of Civil Cases of the Supreme Court of Georgia, a collection has been published upon business disputes.   

The chairperson of the Supreme Court of Georgia offered the conference participants, within the framework of the  Scientific Advisory Council, to have further mutual discussions  upon actual issues of court practice and  in order to develop guidelines for unified court practice.
