MEETING OF THE SCIENTIFIC-CONSULTING COUNCIL OF THE SUPREME COURT CONCERNING THE CRIMINAL LAW MATTERS

On July 23 of 2016 at the Supreme Court was held a regular meeting of the scientific-consulting council concerning the Criminal Law matters. The meeting was presided by the chairperson of the Supreme Court and High Council of Justice. The participants were judges hearing the criminal cases and representatives of the Prosecution Office of Georgia.
Within the frames of the meeting the problem of revalidation of the lawfulness of the carried out investigation activities (making a search/ seizure, capture) in case of emergency and without the valid judgment on the basis of the articles 112- e and 120-125 –e was also considered. The participants of the meeting taking into account the Court practice on the basis of the corresponding hypothetic cases examined the necessity of regulation of the mentioned problem on the legislative level and determination of the holistic view.
The participants briefly discussed the amendment made in the second part of the article 3321 of the Criminal Procedural Code entered into force on June 22 of 2016, according to which due to the newly revealed circumstances the decision will be reconsidered, on the basis of the Resolution N76-I of the Parliament on the “ persons arrested out of political sign and persecuted out of political sign” passed on December 5 of 2012, being applicable for the convicted persons arrested out of political sign and persecuted out of political sign. In regard to the above mentioned problem the large scale discussion will be held within the format of the next meeting of the scientific-consulting council of the Supreme Court.
