THE SUPREME COURT OF GEORGIA’S SCIENTIFIC-CONSULTATIVE BOARD MEETING IN THE DIRECTION OF CRIMINAL LAW

On April 27 of 2016 in the Supreme Court of Georgia was held the next scientific-consultative board meeting covering the criminal justice matters. The meeting was presided by the Chairperson of the Supreme Court and High Council of Justice - Nino Gvenetadze. Judges considering criminal cases, representatives of the academic circles and lawyers attended the meeting.
Within the frames of the meeting the participants discussed amendments made to the Criminal Code, concerning the articles 370 (false testimony, perjury, failure to protect the subject of expert research or mistranslation) and 3711 ( giving of the contradicting testimonies by witnesses and victims). Videlicet, according to the legal developments, from February 20 of 2016 in accordance with the operating Criminal Code, legislators establish responsibility not for the contradictory testimonies, but for giving the false information ( testimony ). The participants discusses the hypothetic casus concerning the above mentioned problem.
Along with the above mentioned issues, the participants of the meeting gave consideration to the prospective legislation of Georgia on making amendments before culmination of the criminal proceedings to the article 80 - decision on the material evidence. Elaboration of the prospective legislation was conditioned by the legal shortcomings in legal regulation concerning taking out of the motor vehicles as a physical evidence. Videlicet, the cases when it is impossible to establish the owners/legal possessors of motor vehicles or place of their residence and consequently serve a notice to them are in abundance in practice. The above mentioned, causes protraction of the decision on the fate of the real evidence, placing of motor vehicles in the special parking lot for an indefinite period and other negative outcome.
