Court is coming with the initiative to establish the mediation institute

On November 4, 2011, the meeting “introduction-establishment of the mediation institute in Georgia” was conducted at the Tbilisi Ivane Javakhishvili State University.
Mediation institute is the novelty in the Georgian court system. As a result of the establishment of the court mediation, cases regarding the family, neighborhood and succession disputes, where the settlement between the parties is likely to exist, will be transferred to the mediator.
The mediator will be the neutral person, who will explain to the both sides the existing situation of the case and try to settle the dispute between them.
The main priority of the mediation institute is the involvement of the parties in their own case resolution process. With the assistance of the mediator, the parties make decision on the case by their own.
The mediation institute is widely spread in the United States of America and Europe. For example, in the Unites States of America 95% of the disputes are resolved through the mediator. According to the German court practice, only 10% of the same category cases are brought before the court and all other cases are resolved by parties themselves with the help of mediator.
The meeting was conducted on the basis of cooperation between the National Center for Alternative Dispute Resolution of the Tbilisi State University, the Supreme Court, Tbilisi Court of Appeal and the High Council of Justice.
The Professors of the University, lawyers, court experts and representatives of business-association were taking part in the discussion.
