According to the judgment of Kutaisi City Court, which was delivered on July 8, 2013, the accused Kakha Getsadze and Givi Arabidze were acquitted. The investigation was launched against Mr. Kakha Getsadze into the charges of instigation abuse of authority, and against Mr. Givi Arabidze into the charges of abusing authority. According to the indictment, the head of Zestaponi Municipality Mr. Givi Arabidze, who at the same time was the chairman of the bidding commission, in order to gain the preference for Mr. Filimon Ghaghanidze, who was the close friend of Deputy of Zestaponi District Mr. Kakha Getsadze at the material time, contrary to the requirements of public procurement rules for the implementation of the provisions, fulfilled the request of Mr. Kakha Getsadze and on December 7, 2010, at 14:00 did not registered, that receiving of the tender offers was finished and accepted Mr. Filimon Ghaghanidzes application lately and gave him ability to participate in the tender in the name of Ltd “Bakhturidze and Company”. As a result Mr. Filimon Ghaghanidze won in the two lots against the competing the company and a trade agreement was signed. During the examination of the merits of the case, it was established that the examined evidences were not sufficient to prove the charge against accused persons and, therefore, the court acquitted the defendants.
