On August 3 of 2016 the regular meeting of the scientific-consulting council concerning the criminal legislation matters was held in the Supreme Court. The meeting was presided by the chairperson of the Supreme Court and High Council of Justice. Judges hearing the criminal cases, as well as the representatives of the Prosecutor’s Office, State Security and apparatus of the Inspector for security of personal data attended the meeting.
The subject of discussion was the practice of considering the motions based on the operative-investigative activities by the Courts. In particular, the participants examined in details the legal issues relating the time when to start investigative activities concerning computer data and other issues referred to the annulment of judicial decision.
During the discussion the participants marked, that on the basis of the request of the information, it is important that the operative part of the judicial decision to reflect precise formulation and maintain the homogeneous terminology.
Within the frames of the meeting the participants also discussed the necessity of the highest possible specificities on the level of the list of the investigative activities concerning computer data as provided for in the Criminal Procedural Code under the articles 136-138.
