On April 21 of 2016 The Chairperson of the Supreme Court and High Council of Justice Ms.Nino Gvenetadze by the official invitation of the Council of Europe is taking part in the two day High Level Conference of the Ministers of Justice and Judiciary, being held in the capital of Bulgaria – Sofia on the following topic: “Strengthening Judicial Independence and Impartiality as a Pre-condition for the Rule of Law in Council of Europe Member States”. The above mentioned Conference is being organized by the Ministry of Justice of Bulgaria with the support of the Council of Europe.
Minister of Foreign Affairs of the Republic of Bulgaria – Mr. Daniel Mitov; The Secretary General of the Council of Europe – Mr. Thorbjorn Jagland and Minister of Justice of Bulgaria – Ms. Ekaterina Zaharieva opened the Conference and greeted the participants.
Within the frames of the Conference the delegates will make reports about the role of Justice in the democratic society, discuss the relations between the executive authorities and judiciary, as well as the defense of independence of an individual judge and matters concerning the provision of impartiality.
One of the aims of the Conference is discussion of the draft of the Action Plan: “Strengthening the Independence and Impartiality of the Judiciary” elaborated by the Committee of Ministers of the Council of Europe and with the participation of the corresponding member States to agree upon the final version of the plan.
The Action Plan elaborated by the Committee of Ministers of the Council of Europe stipulates to determine the particular tasks and arrangements aimed at strengthening of independence and impartiality of Courts. The aforementioned process will be led and coordinated by the Council of Europe. Videlicet, the Action Plan and its appendix defines the activities to be fulfilled by the member States concerning the independence of the Court and building and improvement of the guarantees of formal, legal impartiality. According to the document it is necessary to operate and implement the corresponding structures and policy, for providing putting into practice of the guarantees maintained by the plan. It will help the appropriate functioning of the Judiciary in the democratic society founded on the Human Rights and Rule of Law.
Arising out of the diversity of approaches to the legal systems, Constitutional positions and distribution of power of the Countries of the Council of Europe, the participants of the Conference within the frames of the meeting will document their opinions on the fulfillment of the activities maintained by the Action Plan.
On April 22 of 2016 the High Level Conference of the Ministers of Justice and Judiciary will be closed with the agreement on the final version of the Action Plan – Strengthening the Independence and Impartiality of the Judiciary” and summarizing discussion on the topics reviewed within the frames of the Conference.
