The Scientific –consultative board meeting of the Supreme Court of Georgia on the criminal law direction

On November 17, 2015 in the Supreme Court the Scientific-consultative board’s regular session was held on criminal law direction. The meeting attended: the judges of the criminal collegium of Tbilisi City Court, the criminal chamber of Tbilisi Appellate and Supreme Courts, advocates, representatives of scientific circles and other specialists in the field.
The participants of the session discussed the issues of courts’ supervision procedures for Human rights protection during pre-trail investigation and pre-trail reviewing. Namely, participants paid particular attention on imposition of preventive measures and on search / extraction regulatory procedures. In the framework of motioned topics the parties discussed the Constitutional Court decision adopted on September 15, 2015, # 3/2/646 that is dealing with the term of pre-trial detention, namely, compliance of normative content of Article 205, Part 2 of Criminal Procedure Code with the constitution.
The topic of discussion also was the amendments to the draft law of the Criminal Procedural Code of Georgia on jury trial. The parties discussed the document of preliminary analysis of the mentioned draft law, elaborated by the international expert - Nikolai Kavalev. The aim of creation of the document presents to check compliance of the draft law’s provision with international human rights standards and best practices in other countries.
At the end of the session, coming out from the urgency of the issue, participants in addition discussed the issues related to the Article 260 of the Criminal Code in the form of case study.
