The Statement of the Supreme Court of Georgia

Published: 07/05/2013

On July 3, 2013 Akhaltsikhe District Court found the five accused persons not guilty. According to the courts verdict, the former head of Akhaltsikhe Unit of the Ministry of Interior Mamuka Khvedeliani and the four former employees of the same department were found not guilty in the charge of committing a crime.

It is almost two days that on the above mentioned decision the office of the General Prosecutor issued not only the incorrect, but discrediting the court statements.

Today, on the briefing which was held at the General Prosecutor’s Office, it was reported that, allegedly, the chairman of the Akhlatsikhe District Court offered to the District Attorney to conclude a plea agreement with the accused person concerning the case.

The situation of the case was quite the opposite: the high officials of Akhaltsikhe District Prosecutors Offices had asked whether it was appropriate, to conclude the plea agreement in connection with the case. The court responded in the following way: the plea agreement is concluded between the parties and if such document is filed before the court, the court examines it according to the law established rules.

The Court stated that replication the falsehood from the General Prosecutors side, not only misleads the public, but also the proliferation of such information to the Prosecutors Office is trying to discrediting the court.
The judgment of acquittal delivered by the Akhaltsikhe district court on July 3, 2013 was based solely on the case materials and the fundamental principles of adversarial nature of the judicial proceedings.
