The Statement Of The Chairman Of The Supreme Court of Georgia

On April 29, 2013, the Chairman of the Supreme Court of Georgia Mr. Konstantin Kublashvili held the special briefing and commented on the recent statements concerning the “Law on common courts of Georgia”.

The Chairman of the Supreme Court talked about the political side of the discussion process of the “Law on common courts of Georgia”: “As you already know the President vetoed the Law and now the Parliament of Georgia will discuss the reasons why the president vetoed the Law; or how the Parliament will resolve the issue, this is the political side of the matter and the Judiciary will not be involved in the process. Here, I would like to call on all the politicians to refrain from the statements that endanger the reform process”. 

The Chairman of the Supreme Court also commented on his assessment which he made about the regulations of the Venice Commission and how the regulations are reflected in the “Law on common courts of Georgia”.

Mr. Konstantin Kublashvili said: “the regulations presented in the”Law on Common Courts” did not fully comply with the provisions provided by the Venice Commissions recommendations. I think that such a precedent, according to which the office term of Judge Members of the High Council will be early terminated, really do not strengthen the Georgian Judiciary. Nevertheless, our aim is not to hamper or postpone the process artificially. Any system can be improved, and I believe that among of these developments are innovative provisions that will ensure the proper functioning of the Court system even more”. 

Mr. Konstantin Kublasvili also informed the public about the preparation work conducted for the Conference of Judges Association. As the Chairman of the Supreme Court stated, on April 30 at 1300 p.m., the meeting of the Administrative Committee will be held in the Supreme Court of Georgia, when the Secretariat will be elected. “The Judiciary will wait for the final completion of the Law adoption process and will provide the Judge Association Conference to be conducted within the law established time limits, where without any pressure the judges will elect the members of the High Council of Justice, who will contribute to ensure effective implementation of the Judiciary activities”. – Declared Mr. Konstantin Kublasvili. 

The meeting of Administrative Committee will be open and all the interested persons may attend, including the representatives of international and local NGOs.
