Three court verdicts of not guilty

For the last two weeks, Tbilisi and Kutaisi City Courts passed verdicts of not guilty for three accused and released them from the courtroom.

Genadi Subar was accused of a theft by the Public Prosecutor’s Office; in particular, he was accused of stealthy taking the possession of a double-wing iron door of the defensive fence of the natural park at №3, Guramishvili street, Tskneti settlement, Tbilisi. As the case materials evidenced, the door was withdrawn from the yard of GenadiSubar’s residential house as the evidence on June 24, 2010. 

During the preliminary and court investigations, Genadi Subar did not admit his guilt and explained that the iron door had been broken down aiming at preventing strangers from stealing it. He kept the door in his yard.
The neighbors of the accused, who were interrogated as witnesses in the courtroom, completely confirmed Genadi Subar's story. 

At passing the verdict, the Court considered these evidences and other evidences investigated during the essential case trial, which were not considered sufficient to pass a verdict of guilty of Genadi Subar of the brought accusation. Consequently, on February 27, 2010 Tbilisi City Court recognized Genadi Subar not guilty of the accusation brought against him and passed a verdict of not guilty. 

Another verdict of not guilty was passed by Tbilisi City Court on March 11.
This time, the Court released Ilia Pridonashvili from the courtroom. According to the case materials, the Public Prosecutor’s Office accused him of illegal possession of a movable thing belonging to someone else. During the court investigation, the accused did not admit his guilt of the accusation brought against him and explained that at the time of the crime he was at his aunt’s, in the city of Dusheti to celebrate the Easter. The evidence given by Pridonashvili was confirmed by witnesses’ testimonies and other authentic evidences of the case, which show that in the period of commitment the crime, Ilia Pridonashvili was in Dusheti. The Court subscribed to Pridonashvili’s testimony about his innocence, as the prosecution failed to present additional evidence, which would be the sufficient grounds to admit the guilt of the accused. 

On March 11, Kutaisi City Court passed another verdict of not guilty. The Court justified the accused NugzarAkhalaia, who was accused of intentional purchasing a thing obtained by a criminal way and released him from the courtroom. The judge, after considering the case materials and matching the evidences, established that the prosecution failed to present sufficient evidence against NugzarAkhalaia. 

At establishing the verdict of not guilty, Kutaisi City Court was guided by the Criminal Procedural Code of Georgia, under which any doubt not proved by the legally established procedure must be settled in favor of the accused.
